Residential Rental Inspections & Licenses

As part of an effort to ensure the safety of its residents, Brookhaven Borough Ordinance 776 requires all persons operating residential rental units to annually apply for and obtain a license for each unit.  After completing the Residential Rental Inspection & License Application and paying the required $100 fee, a Borough inspector will call to schedule the inspection.  Once the the inspection is passed, a License will be issued that is valid for one year.  If an inspection is failed the Operator will receive an inspection report and will have 30 days to correct any deficiencies.  One reinspection is included as part of the application fee.  If for any reason a marked deficiency is found not to be corrected, an additional inspection fee of $60 may be charged. This list covers most of the common items that may be in violation but it is not all inclusive.

Inspections may be applied for up to 60 days prior to the expiration of any license.  License renewals shall be for 1 year from the previous license expiration date. Applications must be received at least 2 weeks before inspection is needed.  To speed up the application process, the application can be emailed to: permit@brookhavenboro.com and the check can be mailed or dropped off at the Inspector’s Office in the Brookhaven Municipal Center or paid online

Q1. Where are smoke detectors and CO detectors required?
UPDATED 7/1/2024: Every Dwelling must have one smoke detector on each floor located in common space, each sleeping space must also have a smoke detector. Units with fuel burning appliances or a garage must have a CO detector located in the common space directly outside of the sleeping space or in the sleeping space if the fuel burning appliance is in the sleeping space.   
Q2. Why do I have to do this now, I have never had my rental unit inspected before?
In 2014 Ordinance 776 was passed. This ordinance states:
The Council finds that it is in the best interest of the citizens of the Borough to declare that all owners of residential rental properties be licensed to offer residential rental property for lease and that such residential rental properties be subject to annual inspection to protect the health, safety and welfare of Borough residents and ensure compliance with the housing, building, safety, plumbing, electrical, and fire prevention ordinances of the Borough.
Q3. Where do I need extinguishers?
Most houses and apartments need only 1 extinguisher located in the kitchen. That extinguisher must meet the following conditions:
It must be rated 1A:10B:C minimum.
It must be in good usable condition.
It must be within the manufacturers service life as indicated by the date code.
Additional extinguishers may be required in garages or workspaces.
