Brookhaven’s Zoning Code, adopted September 2018, is based on the goals and recommendations of the most recently adopted Brookhaven Borough Comprehensive Plan, including the following specific community development objectives:

  • The control of land development in areas that are flood-prone along Chester and Ridley Creeks
  • The improvement of stormwater drainage problems within the Borough
  • The development of park and recreational areas within the Borough and the preservation of existing open space
  • The lessening of traffic congestion by the regulation of commercial development along Edgmont Avenue and Brookhaven Road
  • The improvement of the character, appearance, and accessibility of commercial development along the Edgmont Avenue commercial corridor

Zoning Permit Application

A Zoning Permit is required prior to the erection, alteration or extension, or change in use or conversion of any building, structure or a portion thereof, and prior to the use or change in use of a building or land, and prior to the change or extension of a non-conforming use or structure.  The following are some items requiring zoning approval.

  • changes to driveways
  • new sidewalk or patio
  • sheds
  • fences
  • new businesses
  • signs
  • additions
